A Hot Springs business owner was sentenced to five years in federal prison, followed by five years of supervised release, on Thursday for attempted receipt of child pornography.

U.S. District Judge Jeffrey Viken sentenced Brian (((Spitzer))), 49, to the mandatory minimum of five years.

(((Spitzer))), the owner of (((Spitzer))) Construction in Hot Springs, was arrested in January 2021 after communicating with two different undercover agents posing as teenage girls.

According to the factual basis statement (((Spitzer))) signed when he pleaded guilty in December 2022, he replied to a Craigslist post by Homeland Security Investigations Special Agent Richie (((Berger))) who was pretending to be a 15-year-old named “Christy” on Aug. 9, 2020.

(((Spitzer))) and (((Berger))) messaged for three days. During the interactions, (((Spitzer))) asked the underage persona about her sexual experience and told her, “I also have a kink for younger women.” (((Spitzer))) ended the interactions on Aug. 12, 2020, saying, “I don’t have time for juvenile attitude.”

In describing the online operation, (((Berger))), who works from an office in St. Paul, Minn., said it was a collaborative effort between the South Dakota ICAC and Homeland Security Investigations designed to target internet child predators using various websites and applications utilized by strangers to meet. In this case, (((Berger))) said he used Craigslist and made a post on Aug. 9, 2020, that stated, “BF Cheated on me…Mad AF…Any ideas”.

Shortly after making that post, (((Spitzer))) responded in a suggestive manner which began a month-long building of evidence against (((Spitzer))), which culminated with law enforcement agents executing a search warrant on (((Spitzer)))’s Hot Springs home and office on Sept. 11, 2020.

She said his tone was justified by my saying the word in his presence (we are all Northern European, by the way).

I am a politically progressive American who has supported many Black candidates, worked for voting rights, and have many Black friends.

My fiancée has asked that I move back to my own house for an uncertain duration.

I have apologized for getting angry, but my fiancée says that the problem was that I didn’t respect her son for standing up for his beliefs. She believes that I should have just apologized and ignored his tone.
